Sales conditions
  1. The Item for Sale
  2. Potential buyers are invited to inspect the items that may interest them before the auction, particularly during the exhibitions. FARRANDO auction house is available to provide reports on the condition of the lots. The descriptions of the lots in the catalogue, reports, labels, and verbal indications or announcements are merely FARRANDO auction house’s perception of the lot and cannot be considered as evidence of a fact. Dimensions are given for informational purposes. The indications provided by FARRANDO auction house regarding any restoration, damage, or incident affecting the lot are expressed to facilitate its inspection by the potential buyer and remain subject to their personal assessment or that of their expert. The absence of a mention of restoration, damage, or incident in the catalogue, reports, labels, or verbally, does not imply that an item is free from any existing, past, or repaired defects. Conversely, mentioning a few defects does not imply the absence of all other defects. The estimates are provided solely as a guideline and cannot be considered as implying certainty that the item will be sold at the estimated price or even within the estimated range. Estimates cannot constitute any form of guarantee.
  3. The Sale
  4. FARRANDO auction house reserves the right to ask any potential buyer to provide proof of their identity and bank references. The auction house reserves the right to deny access to the auction room to any potential buyer for valid reasons. Anyone bidding at the auction agrees to pay the bid price immediately and personally, plus the buyer's fees and any applicable taxes. Each bidder is presumed to be acting on their own behalf unless prior notification of their role as a proxy for a third party is accepted by FARRANDO auction house. The normal mode for bidding is to be present in the auction room. However, FARRANDO auction house may graciously accept bids via telephone from a potential buyer who has expressed interest before the sale. The auction house cannot be held responsible if the phone connection is not established, is delayed, or if errors or omissions occur regarding telephone bids. FARRANDO auction house may graciously accept written bidding instructions transmitted to it before the sale and that it has accepted. If the auction house receives multiple bids for identical amounts, the oldest bid will take precedence. The auction house cannot be held responsible for any errors or omissions in the execution of written instructions. However, the seller will not be allowed to bid directly or via proxy. FARRANDO auction house will conduct the sale at its discretion while respecting established practices. The auction house reserves the right to refuse any bid, organize bids in the most appropriate way, move certain lots during the sale, withdraw any lot from the sale, or combine or separate lots. The hammer strike will signify the end of the bidding, and the pronouncement of the word "Adjudged" or any equivalent will form the sales contract between the seller and the final bidder. The successful bidder can only take delivery of the lot after full payment of the price. If a regular cheque is provided, only the cheque’s clearance will constitute payment.
  5. Execution of the Sale
  6. The sale will be expressly for cash and conducted in euros. Buyers will pay, in addition to the bid price, the following fees and taxes per lot:
  7. • 26.4% including VAT for voluntary sales.
  8. Buyers via Drouot Live will pay, in addition to the auction house's fees, a commission of 1.8% including VAT, which is forwarded to the platform.
  9. Taxes (VAT on commissions) may be refunded to the successful bidder upon presentation of export documents outside the EU. A EU-based successful bidder who provides a VAT number will be exempt from paying VAT on commissions. Payment for the lot will be made in full for the price, fees, and taxes, even if an export license is required.
  10. The successful bidder may pay by:
  11. Cash: up to €1,000 including fees and taxes for French and European nationals, up to €15,000 including fees and taxes for foreign non-professionals, with identity documents.

  15. FARRANDO auction house will be authorized to reproduce the information provided by the successful bidder on the sale report and auction slip. Any false information will make the bidder liable. If the bidder has not registered before the sale, they must provide the necessary information immediately after the lot is adjudicated. The bidder is responsible for insuring the lot once adjudicated. They cannot claim against FARRANDO auction house if the insurance compensation for loss, theft, or damage is insufficient. The lot will not be delivered to the buyer until full payment is made. In the meantime, the auction house may charge the buyer for storage fees, and possibly handling and transport costs. In the event of non-payment by the successful bidder, after a failed formal demand, the item will be re-offered for sale at the default bidder's expense.
  16. Additionally, FARRANDO auction house reserves the right to claim from the defaulting bidder, at its discretion:
  17. Interest at the legal rate plus five points,
  18. Reimbursement of the additional costs incurred by their default,
  19. Payment of the difference between the original bid price and the bid price at the re-sale if lower, along with costs generated by the new bidding. The auction house also reserves the right to offset any amounts owed by the defaulting bidder. FARRANDO auction house reserves the right to exclude from future sales any bidder who has defaulted or failed to comply with these terms. The information collected on registration forms is mandatory to participate in the sale and manage the auction. The successful bidder may access and rectify their data or object for legitimate reasons to further processing by sending a written request with a copy of identification to the auction operator by mail or email. The voluntary auction operator is a member of the TEMIS Registry for the prevention of unpaid debts by auctioneers, where payment incidents may be recorded. Access rights, rectification, and legitimate opposition must be exercised by the debtor concerned with Commissaires-Priseurs Multimédia, 37 rue de Châteaudun, 75009 Paris, or by contacting contact@temis.auction.
  20. Sale Incidents
  21. If two individuals place identical bids verbally, by gesture, or by phone, and both claim the benefit of the adjudication after the hammer strike, the lot will be immediately re-offered at the price proposed by the last bidders, and the entire audience will be allowed to place new bids.
  22. French State Preemption
  23. The French State has a right of preemption for works sold in accordance with applicable regulations. This right can be exercised immediately after the hammer strike when the representative of the State expresses its intention to replace the last bidder, confirming the preemption within 15 days. FARRANDO auction house cannot be held responsible for the conditions of the French State's preemption.
  24. Legislative and Jurisdictional Competence
  25. French law exclusively governs these general conditions of sale. Any dispute regarding their existence, validity, enforceability against any bidder or buyer, or their execution will be settled by the competent court in the Paris jurisdiction (France).
  26. Lot Withdrawal
  27. The buyer is responsible for insuring their acquisitions, and FARRANDO auction house declines any responsibility for damages the item may incur once the adjudication has taken place. All formalities and transport remain the exclusive responsibility of the buyer.
  28. The lots are kept in a secure facility and may be collected by appointment from the auction house. The auction house does not provide shipping or packaging.

  35. Data Protection
  36. As part of our auction activities, our auction house collects personal data concerning both the seller and the buyer. They have the right to access, rectify, and object to the processing of their personal data by directly contacting our auction house. We may use these personal data to fulfill our legal obligations and, unless opposed by the concerned individuals, for the exercise of our activities (including marketing and commercial operations). This data may also be communicated to the relevant authorities when required by regulation.
